Context is key when defending radiology claims

In a recent article published in the New York Law Journal, Andrew Kaufman, founding partner of Kaufman Borgeest & Ryan, outlines how to handle hindsight bias when it comes to defending radiology claims.

Kaufman discusses how claims against radiologists will result in delays and diagnosis of treatment in progressive diseases such as cancer.

He lists the four main reasons why radiologists are sued:

  • Errors in perception.
  • Errors in interpretation.
  • Failure to suggest the next appropriate step or procedure.
  • Failure to communicate to the patient or clinician in a timely and appropriate manner.

He said errors in perception form the basis for a vast majority of radiology claims: “Coincidentally, such claims are susceptible to a pernicious and insidious form of bias on the part of plaintiff's expert as well as the jury.”
