Months after Rose Radiology settled with the federal government for violating the False Claims Act, the Florida-based practice is now saying lawyer Barry Cohen breached attorney-client privilege by helping coordinate one of the whistleblower cases against it.

Back in February, Rose Radiology agreed to pay $8.71 million to the government after numerous allegations, releasing an official statement on the agreement days later.

Now, according to a new report by The Tampa Bay Times, Rose Radiology is pointing to a phone call between Cohen and Rose Radiology owner Manuel S. Rose, MD, as proof that its allegations against Cohen are true. The phone call took place in April 2013, and Cohen and Rose discussed a federal subpoena served to Rose Radiology. The following year, there were two separate whistleblower cases against Rose Radiology, and Cohen’s firm represented the individual behind one of those cases.

Cohen said the civil suit is “distorted, corrupt and unfounded,” according to the Times, adding that his firm “never made a dime” off the case.
